These Terms of Service ("Terms") govern your use of the fivedaylaunch service, website builder, hosting, admin portal, and related digital services (collectively, the "Service") provided by Softlynx Dataworks Private Limited ("we", "us", "our"). By creating an account or using the Service, you ("you", "Customer") agree to these Terms.

You must be at least 18 years old and legally able to enter into contracts under Indian law. You are responsible for all activity on your account, for keeping login credentials confidential, and for immediately notifying us of unauthorized use. We may suspend or terminate accounts that appear to be fraudulent, dormant beyond 12 months, or used in violation of these Terms.

All fees are quoted in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Payments are collected via Razorpay Software Private Limited, an RBI-authorised payment aggregator. We do not store your full card, UPI, or banking credentials — only tokens necessary to process authorised recurring charges.
Our five-day delivery commitment starts the business day after we receive: (a) your full-price payment or first subscription charge, (b) your business content (logo, photos, copy) or explicit approval to use AI-drafted copy, and (c) your preferred domain name. Delays caused by missing customer inputs pause the countdown.
Cancellation and refund conditions are set out in our Refund and Cancellation Policy. You may cancel a monthly subscription at any time from the customer portal; the cancellation takes effect at the end of the current billing period.
You agree not to use the Service to publish or transmit content that is illegal, obscene, defamatory, hateful, infringing on third-party intellectual property, promoting gambling or unlicensed financial products, or otherwise in violation of the Information Technology Act, 2000 and rules made thereunder. We may take down content or suspend accounts on receipt of a valid complaint or lawful order.
You retain full ownership of your business name, logo, photographs, and original copy you provide. On full payment, we assign to you all rights, title and interest in the assembled website design, HTML, CSS, and content files delivered under a "one-time build" plan. Third-party components (open-source libraries, stock photographs, fonts) remain under their respective licences. The fivedaylaunch platform, editor, admin portal software, and any generative-design system remain our exclusive property and are licensed to you on a non-exclusive basis for the duration of your subscription.
Your use of the Service is subject to our Privacy Policy, which describes what data we collect, how we use it, your rights under the Digital Personal Data Protection Act, 2023, and how to reach our Grievance Officer.
We provide the Service on an "as available" basis. We target 99.5% monthly uptime for hosted sites, excluding scheduled maintenance and events outside our reasonable control (force majeure, third-party outages, cyber-attacks, or acts of civil authority). We do not warrant that the Service will be error-free or that it will deliver any specific business result (traffic, leads, revenue).
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service in any 12-month period shall not exceed the fees you paid us during that period. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, or data, even if we have been advised of the possibility of such damages.
You will defend, indemnify, and hold harmless fivedaylaunch and Softlynx Dataworks Private Limited from any third-party claim arising from your content, your use of the Service in violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at [FILL: e.g. Hyderabad, Telangana]. Nothing in this section prevents either party from seeking injunctive relief in any competent court.
We may update these Terms from time to time. Material changes will be communicated via email to your registered address at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
